윤기진 대표 황선 구속 적부심 앞두고 눈물의 탄원서

통일이야기공연에 참석했다가 국가보안법위반혐의로 구속 수감 중인 희망 정치 포럼 황선 대표의 남편인 민권연대 윤기진 대표가 황 대표의 구속 적부심을 앞두고 석방 탄원서를 발송했다.

통일이야기 진행자 였던 황선 대표의 구속적부심은 2일 오후 2시 서울 지방법원에서 진행 되었다. 통일콘서트진행자 황선 석방 및 명예회복을 위한 대책위원회는 남편 윤기진씨의 황선 구명위원회는 석방촉구 서한(한글, 영문)을 국제엠네스티, 유엔인권위 유엔인권고등판무관, 각국(미국,러시아,중국,일본,유럽연합) 정상에 발송했다고 밝혔다.

윤기진 대표는 ‘제 아내를 가정으로 돌아올 수 있도록 도와주십시오.’라는 편지를 통해 “제 아내는 지난해 11월부터 한국 전역에서 재미동포 신은미 씨와 함께 통일토크문화콘서트를 진행했다.”며 “두 여성은 방북경험이 있기에 한국 국민들이 북한을 아는 데 자신의 경험담이 도움이 되리라 여겼다. 그런데 황당하게도 신은미 씨는 국가보안법 위반 혐의로 검찰 수사를 받고 강제로 출국 당했고 콘서트를 진행한 제 아내는 구속이 됐고 저까지 콘서트를 배후조종했다는 혐의로 수사를 받고 있다.”며 참담함을 토로했다.

윤기진 대표는 “검찰은 토크문화콘서트 내용만으로는 기소하기 어렵다고 판단했는지 제 아내가 옛날에 쓴 시와 일기장들을 문제 삼아 구속했다. 세상에 자신만 보기위해 쓰는 일기를 가지고 처벌하는 나라도 있느냐”며 항변했다.

윤 대표는 “분단 현실을 핑계로 직접 보고, 듣고, 느낀 점을 표현하는 것조차 ‘북한 찬양’으로 간주하고 처벌하는 것은 인류 보편적 권리인 ‘표현의 자유’를 명백히 박탈하는 것”이라면서 “몇 해 전부터 한국에 유행하는 극심한 ‘종북 마녀사냥’은 ‘표현의 자유’를 포함해 인간의 기본권을 심각하게 유린하고 있다. 이런 이유로 많은 시민들이 하고 싶은 말이 있어도 겉으로 표현하지 못하며 두려움에 떨고 있다. 마치 과거 한국에 존재했던 군사독재정부 치하나 2차 세계대전 당시 독일 나치당 치하의 모습을 보는 듯 하다.”며 한국의 인권 상황을 고발했다.

그는 “한국 정부가 표적수사, 공안탄압을 중단하고 제 아내를 즉각 석방하도록 관심을 가져 달라”며 “한국 정부와 언론이 ‘종북 마녀사냥’을 즉각 중단하고 ‘표현의 자유’를 보장하도록 노력해 달라.”고 호소했다.

세계 인권 증진을 위해 애쓰시는 귀하에게 경의를 표합니다.

제 아내는 통일운동가 황선입니다. 분단된 조국에 사는 사람이기에 통일운동을 숙명처럼 생각하는 사람입니다. 저도 아내의 활동을 물심양면 지원해왔습니다.

통일을 위해서는 남과 북이 서로를 잘 알아야 합니다. 그래서 제 아내는 지난해 11월부터 한국 전역에서 재미동포 신은미 씨와 함께 통일토크문화콘서트를 진행했습니다. 두 여성은 방북경험이 있기에 한국 국민들이 북한을 아는 데 자신의 경험담이 도움이 되리라 여겼습니다.

그런데 황당하게도 신은미 씨는 국가보안법 위반 혐의로 검찰 수사를 받고 강제로 출국당했습니다. 함께 콘서트를 진행한 제 아내는 구속이 됐고 저까지 콘서트를 배후조종했다는 혐의로 수사를 받고 있습니다. 제 아내는 두 초등학생 어린이의 어머니로 이번 구속으로 인해 아이들이 큰 상처를 받았습니다.

검찰은 토크문화콘서트에서 신은미 씨가 부른 ‘심장에 남는 사람’이란 노래가 북한 지도자를 찬양한 가요로 규정했습니다. 그러나 이 노래는 2007년 북한과 저작권 협의를 거쳐 한국에서 음반으로 발매되었고 대중가수들이 TV에서 부르기도 했습니다.검찰은 제 아내가 단지 노래 부를 때 옆에 있었다는 이유로 ‘동조죄’를 적용했습니다.

또 검찰은 “북한 휴대폰 사용자가 250만 명을 넘었다더라”, “대동강 맥주가 맛있다”, “세쌍둥이를 낳으면 나라에서 키워준다”는 발언이 북한 체제를 찬양하는 발언이라고 규정했습니다. 하지만 이런 내용은 이미 몇 년 전 한국 언론과 방송에도 보도되었던 내용들입니다. 똑같은 말을 해도 제 아내가 하면 유죄라는 게 검찰의 주장입니다.

검찰이 토크문화콘서트와 관련해서 구속사유로 제시한 내용은 이게 전부입니다. 검찰은 토크문화콘서트 내용만으로는 기소하기 어렵다고 판단했는지 제 아내가 옛날에 쓴 시와 일기장들을 문제 삼아 구속했습니다. 세상에 자신만 보기위해 쓰는 일기를 가지고 처벌하는 나라도 있습니까?

그러면서 검찰은 제주 4.3항쟁을 추모한 시를 두고 공산무장폭도들의 폭동 사태를 찬양했다고 규정했습니다. 제주 4.3항쟁은 한국 정부가 이미 국가추념일로 지정공포했습니다. 검찰이 법과 정부 결정도 무시하고 ‘종북 마녀사냥’을 하고 있는 것입니다.

분단 현실을 핑계로 직접 보고, 듣고, 느낀 점을 표현하는 것조차 ‘북한 찬양’으로 간주하고 처벌하는 것은 인류 보편적 권리인 ‘표현의 자유’를 명백히 박탈하는 것입니다. 몇 해 전부터 한국에 유행하는 극심한 ‘종북 마녀사냥’은 ‘표현의 자유’를 포함해 인간의 기본권을 심각하게 유린하고 있습니다. 이런 이유로 많은 시민들이 하고 싶은 말이 있어도 겉으로 표현하지 못하며 두려움에 떨고 있습니다. 마치 과거 한국에 존재했던 군사독재정부 치하나 2차 세계대전 당시 독일 나치당 치하의 모습을 보는 듯합니다.

미국 국무부는 통일토크콘서트 사태로 강제출국 된 신은미 씨 문제와 관련해 국가보안법이 표현의 자유를침해하고 있다고 비판했습니다. 1월 9일(미국 현지시각) 젠 사키 국무부 대변인은 정례 브리핑에서 “국가보안법에 관해서는 일부 경우에서 보듯이 그 법이 표현의 자유와 인터넷 접근을 제한하고 있어 우려하고 있다”고 말했습니다. <뉴욕타임스>도 “비판가들은 이적 행위에 관한 모호한 규정 탓에 법 남용 가능성을 우려하고 있으며, 박근혜 정부 집권 이후 그런 남용에 대한 두려움이 커졌다. 지난달에는 작은 좌파 정당(통합진보당)이 해산됐다”고 보도하기도 했습니다.

세계인권선언(Universal Declaration of Human Rights) 제19조에 따르면 “모든 사람은 의견과 표현의 자유에 관한 권리를 가진다. 이 권리는 간섭받지 않고 의견을 가질 자유와 모든 매체를 통하여 국경에 관계없이 정보와 사상을 추구하고, 접수하고, 전달하는 자유를 포함한다”고 합니다.

또한 시민적 및 정치적 권리에 관한 국제규약(International Covenant on Civil and Political Rights) 제19조 2항에 따르면 “모든 사람은 표현의 자유에 대한 권리를 가진다. 이 권리는 구두, 서면 또는 인쇄, 예술의 형태 또는 스스로 선택하는 기타의 방법을 통하여 국경에 관계없이 모든 종류의 정보와 사상을 추구하고 접수하며 전달하는 자유를 포함한다”고 합니다. 대한민국은 1990년 7월 10일부터 이 국제규약을 국내에 적용해왔습니다.

그러나 한국 정부는 세계인권선언과 국제규약을 명백히 위반하고 있습니다.

“한 명에게 직접적인 영향을 미치는 것은 모두에게도 간접적인 영향을 미친다.”

마틴 루터 킹 목사가 1963년 4월 16일 버밍엄 감옥에서 보낸 편지에 실린 말입니다. 신은미 씨와 제 아내가 겪는 일들은 결코 이들에게서 멈추지 않을 것입니다. 지금 한국에 살고 있는 모든 시민들은 국가보안법에 의해, 왜곡·편파보도를 일삼는 방송·언론에 의해, 사회 전반에 퍼져있는 ‘종북 마녀사냥’의 분위기에 의해 표현의 자유를 누리지 못하고 있습니다.

한국 정부가 표적수사, 공안탄압을 중단하고 제 아내를 즉각 석방하도록 관심을 가져 주십시오. 한국 정부와 언론이 ‘종북 마녀사냥’을 즉각 중단하고 ‘표현의 자유’를 보장하도록 노력해 주십시오.

Please Help Me Bring My Wife Back Home from Prison.

First of all, I'd like to express my respect for all of you who have made a great effort to promote human rights around the world.

My wife is Hwang Sun, a reunification activist of Korea. Hwang Sun has sincerely followed her faith and belief in trying to accomplish the reunification of Korea, as she strongly believes that it is her destined obligation to participate in the reunification movements for the sake of Korea, as she is one of the people who love their country, Korea, which is the only divided country in the world. I, as the husband of Hwang Sun, have also given her full material and emotional support in this matter.

To reunite the two Koreas, both the North and South must try to understand each other and get to know their counterparts well. That is why my wife, Hwang Sun, and Shin Eun-mi, a Korean-American, held talk shows for the reunification of Korea across South Korea beginning in November, 2014. These two ladies both visited North Korea several times, and they believed that the various experiences they had while visiting the North would help South Koreans understand North Korea better.

But it turned out to be a very preposterous situation: Shin Eun-mi was investigated for violating the National Security Law by the prosecution for her part in the peaceful talk show and was deported from South Korea and banned from South Korea for five years. My wife, Hwang Sun, has been placed under arrest, and I am being investigated on the false accusation of clandestinely arranging things behind the talk show. My two daughters, who are now in elementary school, were deeply traumatized as their mother was taken to jail.

The prosecution defined the song titled "The Man Remembered by Heart (심장에 남는 사람)," which was sung by Shin Eun-mi at the talk show, as a song that highly praises North Korea's leaders. However, the song was released as a legal album in South Korea in 2007 after an agreement was reached with the North on the copyright, and even some South Korean pop singers used to sing the song on TV shows. The prosecution applied the crime of “Enemy-Sympathy” of the National Security Law to my wife, Hwang Sun, only because she was physically present when Shin Eun-mi was singing the song.

Also, the prosecutors even attacked those comments that my wife and Shin Eun-mi made about North Korea during the talk show, for example, "We heard that the number of cellphone users in the North has amounted to 2.5 million," "North Korea's beer is delicious," and, "North Korea has a policy to help mothers who have triplets," saying that my wife and Mrs. Shin are praising the North Korean regime. However, those remarks mentioned in the talk show were already reported by some South Korean press and media several years ago. What the prosecution is arguing is that it is illegal for my wife to talk about some facts concerning the North, even if those facts about the North are true and have already been reported.

Those are the only charges against my wife, Hwang Sun, that the prosecutors put forth that are related to the talk show. The prosecution also charged my wife of violating the National Security Law based on some poems she wrote and on some personal entries in her diary a long time ago because they did not have enough grounds to indict Hwang Sun. Is there any country that punishes their own citizens on the charge of writing something in a personal diary, which is meant to be read only by the writer, except South Korea?

They also indicted my wife, Hwang Sun, saying that she praised a communist armed revolt based on a poem about the Jeju April 3rd Uprising and Massacre that she wrote to commemorate the victims of the event. The Jeju Uprising and Massacre has already been designated by the Korean government as a national memorial day. The prosecution is intentionally ignoring the law and the legal decisions made by the government and is conducting a witch-hunt against the peaceful reunification movements.

It is obvious that the prosecution is depriving Hwang Sun of her right to the freedom of expression, which is a universal right, by calling what she saw, looked at and felt in the North “admiring North Korea blindly”, and punishing her under the excuse of the reality of the division of Korea. The witch-hunt that condemns unification activists and all the people who desire the unification of South Korea and North Korea as being blind North Korean sympathizers has prevailed in South Korea over the last few years, and has infringed upon fundamental human rights, including the right of freedom of expression. Under these circumstances, many Korean citizens cannot express what they really want to say because they are afraid of being targeted by the prosecution under the National Security Law. It seems like the Korean people are living under the same conditions as in the military dictatorship of South Korea in the past, or of the Nazi Party of Germany during the Second World War.

The U.S. State Department expressed its concern about the South Korean government and about the investigating authorities on the issue related to the deportation of Shin Eun-mi, that the National Security Law of South Korea infringes upon the right of freedom of expression, and Jen Psaki, the U.S. State Department spokesperson, said at a regular briefing on January 9, "We’re concerned that the National Security Law, as interpreted and applied in some cases, limits the freedom of expression and restricts access to the Internet." The New York Times also reported, "Critics said the National Security Law’s loosely worded definition of illegal activities benefiting the enemy leaves it open to abuse. Such fears increased after President Park Geun Hye."

Article 19 of the Universal Declaration of Human Rights specifies that everyone has the right to the freedom of opinion and expression; this right includes the freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers.

Likewise, Provision 2 of Article 19 of the International Covenant on Civil and Political Rights

also states, "Everyone shall have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of his choice." The Republic of Korea adopted the international covenants on human rights on July 10, 1990.

However, the Park Geun Hye administration has clearly violated the International Covenant on Civil and Political Rights and the Universal Declaration of Human Rights.

The quote, "Whatever affects one directly, affects all indirectly," is from the letter by Martin Luther King when he was put in the Birmingham jail on April 16, 1963. I do not believe that what Shin Eun-mi and my wife are suffering will end only in their pain. All the citizens living in South Korea cannot enjoy the right to the freedom of expression out of fear due to the witch-hunt against the so-called 'North Korean sympathizers' that has been conducted across South Korea by some extreme conservative newspapers and media channels under the National Security Law.

I implore you to please be more concerned about the situation of human rights in South Korea so that the Park administration will stop investigations that unfairly target and politically oppress reunification activists, and release my wife, Hwang Sun, from jail immediately.

I also implore you to please provide more support that will make the Park Geun Hye administration and the extreme conservative newspapers and media of South Korea stop the witch-hunt against reunification activists and guarantee the right of the freedom of expression to all the citizens of South Korea.
